In my Probate Real Estate business over the last 22 years one of the road blocks which come up often is dealing with the estates attorney. As a Probate Agent using the I.A.E.A as much as possible I have been usually able to control the situation by positioning myself correctly. You have to understand as either an investor or real estate agent coming into an existing probate in process, the attorney is just not going to do things your way to help you purchase at a wholesale price or earn a listing or sale.

One of the problems an investor will have when making offers on probate real estate, which is going through the court confirmation sale process (California), is the requirement to place a 10% deposit up with your offer. The court requires a cashier’s check, so you must have the money and, if your offer is selected, it will take from 6-8 weeks for your case to go to court for approval.

In California the old Probate Real Estate Sale process requires a 10% deposit based on the sales price upfront while the buyer then waits 608 weeks for the sale to be placed on the court calendar. In court the buyer also stands to lose the purchase to another buyer
